A family court case involving a vulnerable mother has been ordered to be reheard after concerns were raised about procedural fairness and the integrity of the process.
The case, which involved care proceedings, was referred back to the family court after the Court of Appeal found that the initial hearing failed to properly safeguard the mother’s rights.
Lady Justice King stated, “The need for fairness in proceedings, particularly where vulnerable parties are involved, cannot be overstated. It is essential that all parties feel their voices have been heard and their rights respected.”
The mother, who has learning difficulties, had argued that she was not given adequate support during the initial hearing. Her legal team highlighted the absence of appropriate adjustments to assist her in fully participating in the process.
Lady Justice King further noted, “The court has a responsibility to ensure that vulnerable individuals receive the support they need to engage effectively in proceedings that may have life-changing consequences.”
